A judge denied 23XI Racing and motor sport at the forefront of a preliminary injunction in their legal battle against Nascar.
The hope for the injunction was to restore the status of de facto charter of the teams and to stop Nascar issuing charters to other organizations.

The basis of the decision is summed up in Nascar ensuring that they will not sell or reissue the charters of teams specifically before a final decision is taken in the broader case in December, but the question of a widened pool of four additional charters.
Judge Kenneth D. Bell found that this prevented the teams of be an imminent evil Between now and the trial of December 1, writing: “The court concludes that in the light of the renewed commitments of NASCAR to the Court, a preliminary injunction limited to the prevention of the reissue / sale of the disputed charters is not necessary or appropriate, even for the very short period of time until a jury decides on the merit of the claims of the applicants.”

The decision continued: “And, once again, the loss of payments from the” fixed “charter and the uncertainty of continuous relations with drivers and sponsors can be offset by damages in trials or is simply inherent in the risks associated with the trial.
“What will happen for the 2026 racing season will remain unstable for all the people involved in the NASCAR CUP series until after the trial (or a previous resolution among the parties). Consequently, there is no irreparable damage with regard to the loss of charter rights ” for the rest of the 2025 Cup series.”
Jeffrey Kessler, the lawyer representing the teams, published a statement saying: “We are grateful that Judge Bell has clearly indicated that the status quo was maintained – protecting the right of my clients to regain their charters if they prevailed at the trial and guarantee their ability to continue to run during the 2025 season according to Nascar’s commitments.
“Just as important, judge Bell reaffirmed his broad power to command significant changes in Nascar if we succeed, so that teams, drivers, sponsors and fans can benefit from a sport positioned for long -term growth and restored competition. We are ready to present our case in December.”
