Northern Carolina, the Stock Spiritual House Racing, has adopted a law that will prevent mixed development projects such as housing and businesses from encroaching on racing facilities, then fileing complaints of noise prescription.
This is in the form of Bill 926 of the Chamber which includes a provision to “protect the right of racing”. The technical name of article 10 of the bill is “the immunity of race nuisances and immunity on the racetrack”.
This bill, which was adopted by Governor Josh Stein without signature, reads as follows:
“A racing installation will not be subject to any action brought by a surrounding owner in any nuisance or taking a cause of action if the promoter of the race establishment has obtained all the permits required for the construction of the race installation and established a acquired right in the development of the property or a group of adjoining properties or built in the construction of the race zone in the field.
The bill was presented by the representative of the Allen Chosser State, who also chairs the Chamber’s permanent committee on the regulatory reform, in alliance with the Specialcy Equipment Market Association and its branch of the performance race industry, which welcomed its death in a declaration on Wednesday.
“The racing tracks deserve solid champions to defend on their behalf. Too much across the country are faced with direct challenges that threaten their survival. These facilities are more than simple tracks. They maintain jobs, generate local economic activity and embody a vital element of our motorsport heritage, not only in North Carolina, but in national traditions.
Iowa has recently adopted a similar law, as is the South Boston community in Virginia, in response to efforts to build mixed installations around the short emblematic track that shares the name of the city. South Boston Speedway also belongs to the Mattioli family who operates Pocono Raceway of the Nascar Helition.
In addition to the NASCAR sites like Charlotte Motor Speedway, North Wilkesboro Speedway and Rockingham Raceway, North Carolina also welcomes all the teams of the Cup and the XFINITY series and all the teams in the series of trucks except two.
There are 40 motor sports sites in the state and now this bill prevents them from being besieged by what SEMA and PRI calls “Nimbys”.
