NASCAR released an official statement after a judge awarded them a major victory 23XI Race And Motor sports at the forefront in court.
The stock car racing series and both teams have been involved in an antitrust lawsuit since last Octoberwhen 23XI and FRM decided to sue after refusing to sign NASCAR’s new charter contract.
The teams were initially granted an injunction to operate as de facto licensed teams in 2025, but that measure was later rescinded months after the start of the season. Since then, the two have sparred over the issue in court, with NASCAR even revealing that they were looking to sell some of the charters the teams previously owned.
The injunction the teams sought would have prevented this from happening until the outcome of their antitrust lawsuit in December, and would have restored their de facto charter status.
However, a judge made a final ruling on the matter on Wednesday, refusing 23XI and FRM their injunction due to the fact that NASCAR will still have six total charters to hand out if they win their lawsuit, meaning there is no “irreparable harm” to the teams.
23XI and FRM will now operate as open teams for the remainder of the 2025 season.

In an official statement shared following the court’s ruling, NASCAR praised the judge’s decision.

In the final part of its statement following Wednesday’s ruling, NASCAR spoke directly to fans, promising that the ongoing lawsuit would not distract them from their job of delivering exciting racing.
“To the fans,” the stock car racing series wrote. “We will not let this trial distract us from what matters most.
“Deliver the unforgettable moments you expect from our great sport and crown the next NASCAR Cup Series champion on November 2.”
